Fees, Terms and Conditions

Turner Engineering, P.C. will provide electronic files for Contractor’s or Equipment Vendor’s use in preparation of shop drawings related to the project files at a cost of $50 per drawing. Checks should be made payable to Turner Engineering, P.C. and mailed to 349 West Commercial Street, Suite 2190, East Rochester, New York. Drawings will not be e-mailed until we receive a check. These files will be provided in .dwg, .dgn or .pdf format, as requested. Title blocks and all reference to Turner Engineering, P.C., the Architect, or other design professionals will be removed from these electronic files.

Turner Engineering, P.C. cannot assume any responsibility for the electronic files, nor for the accuracy of the floor plans.

Data contained on these electronic files is part of Turner Engineering, P.C.’s instruments of service and shall not be used for any purpose other than as a convenience in the preparation of shop drawings for the project. Any other use will be at your sole risk and without liability or legal exposure to Turner Engineering, P.C. You agree to make no claim and hereby waive, to the fullest extent permitted by law, any claim or cause of action of any nature against Turner Engineering, P.C., its officers, directors, employees, agents or subconsultants which may arise out of, or in connection with, your use of the electronic files. You shall, to the fullest extent permitted by law, indemnify and hold harmless Turner Engineering, P.C. from all claims, damages, losses and expenses, including attorney’s fees arising out of or resulting from your use of these electronic files.

These electronic files are not contract documents. Significant difference may arise between these electronic files and corresponding hard copy contract documents due to addenda, change orders or other revisions. Turner Engineering, P.C. makes no representation regarding the accuracy or completeness of the electronic files you receive. In the event that a conflict arises between the signed contract documents prepared by Turner Engineering, P.C. and electronic files, the signed contract documents shall govern.

You are responsible for determining if any conflicts exist. By your use of these electronic files, you are not relieved of your duty to comply with the contract documents, including and without limitation, the need to check, confirm and coordinate all dimensions and details, take field measurements, field verify conditions and coordinate your work with that of other contractors for the project.
